Public and Private Law Aspects in the AI Act
Abstract dell'evento
With the adoption of the new Regulation on Artificial Intelligence (EU Regulation 2024/1689), in force as of 1st August 2024 and applicable as of 2nd August 2026, the European Union has attempted to take the lead in establishing a modern, pioneering legal framework for artificial intelligence on a global scale.
The Regulation is a very complex and articulated legal source of the Union, encompassing very different legal profiles, taking into account many different needs and challenges, both with regard to the functions of public authorities and to the legal discipline of relations between private actors, professionals and non-professionals.
The role of the Regulation will be crucial in facing challenges both within the European Union (the Regulation is an instrument that overrides the legislations of the Member States and uniforms national legislation) and outside the Union.
For these reasons, after a brief overview of the legal basis, structure, main contents and purposes of the AI Act, issues concerning private and public legal aspects will be addressed. Special attention will be paid to the relevance of the AI Act in relationships between private actors and to the relationship between AI governance and the impact on democratic processes.
