Learning Objectives

The course aims to provide students with the knowledge necessary to understand the fundamentals of the subject, in its individual and collective aspects, as well as to address its main application issues.

Program

a) Trade union law
Introduction - The sources of labour law - Freedom of association - Trade union organization - Representation and trade union representation - Trade union activities in the workplace - Bargaining and the collective agreement - Strike action: background.

b) The right of the individual employment
Labour relations after the Jobs Act - The employment contract - The flexible contracts - The labor market and social safety nets - The obligations of the worker, the powers and duties of the employer - The subjective changes of employment - The individual and collective dismissals.
 

Bridging Courses

Knowledge and understanding: At the end of the training, students will have the necessary tools to understand the rules governing the labor relations, in their individual and collective aspects. We expect, in particular, that they are able to possess an overview of the discipline working trusts, as well as an understanding of the main issues addressed.

Applying knowledge and understanding: Students must know how to analyze legal documents (laws, collective agreements, case law); they also must deal case studies related to personnel management and labour relations. These results will be achieved by exercises related to case studies, seminar meetings.

Making judgemets: Students have to acquire a certain ability inthe  critical interpretation of the matter, integrating knowledge with their point of view. They have to revise the different aspects of the subject with their own judgment. Teaching tools for achieving this goal consist of speeches in room, group discussions, brief statements of some topics already covered in class.

Communication skills: Students have to acquire the ability to speak with a clear and right lexicon. A good command of the legal languarge is required. Teaching tools for achieving this goal consit of front lessons, group works, discussions, seminars, writing assignments.

Learning skills: Students have to develop all the learning skills that are necessary to update their knowledge as well as to gain fundamental skill for the labour market.Teaching tools for achieving this goal consit of front lessons, group works, discussions, seminars, writing assignments

Teaching, Attendance, Course Books and Assessment

Teaching

In order to attend and / or make headway with one's study, students must review the basics of private law related to: sources of law; associations; society; company; bonds; contract.Attending students should show up to class with an update labour code and their course books.

Attendance

b) Employment relationship: F. CARINCI, R. DE LUCA TAMAJO, P. TOSI, T. TREU, Diritto del lavoro. 2. Il rapporto di lavoro subordinato, UTET, Torino, ultima edizione, Chapter II ( §§ 1 to 7), III, IV, V (§§ 1, 2 and 5), VI, VII (literally. A and § 1 of the letter. B), VIII (letter. A, B, C and §§ 1 and 2 of the letter. D), X (letter. B), XI (literally. A and B), XII, XIV (§§ 1 and 2).

The use of an updated Labour Code is required (recommended the available latest edition of Giuffre, Milano).

For students attending the lessons, any further guidance and readings will be provided by the teacher during the same lessons.

Course books

The test consists of an oral discussion concerning the topics covered in the lessons and in the course books. The choice of an oral test is justified by its suitability to allow a more detailed assessment of each student's profile, in terms of knowledge, maturity, critical abilities, and communication skills developed.

Notwithstanding the right of every student to take the exam with an oral discussion concerning the issues addressed in both course books, only to the students attending assiduously is reserved the right to split the exam into two parts: the first, regarding the Trade Union Law (a); the second, regarding the employment relationship (b)

Additional Information for Non-Attending Students

Teaching

The teacher becomes available, by appointment and reception, to foresee some support for student-workers engaged in preparing the exam.

Course books

The non attending students have to study the same course books of the attending students.

Assessment

The exam consists of an oral discussion concerning the issues addressed in both course books mentioned above.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
