Learning Objectives
The aim of the course is to introduce students to an appropriate knowledge of judicial system and judiciary. Students will also learn the correct use of judicial system law sources.
Program
- Fundamental notions: jurisdiction, judge, public prosecutor, magistrate, judicial office.
- The laws on judicial system.
- Jurisdiction: typologies; the space of jurisdiction.
- Constitutional rules about jurisdiction and judges: autonomy, independence, impartiality, pre-determination by law; standard, special and specialized judges; Court of cassation.
- Constitutional rules about public prosecutor: mandatory prosecution; autonomy, independence.
- Constitutional rules about judiciary: standard magistrates, lay magistrates; the superior council of the judiciary.
- Disciplinary and civil liability of judges and prosecutors.
- Judiciary: access to judiciary, career advancement.
- Courts: first instance courts, appellate courts, Court of cassation; courts organization.
- Public prosecutor office organization
