Learning Objectives

The course, starting from a reconstruction of the forms of state and government, will provide students with the fundamental categories of public law for the purpose of a systematic study of the Italian Republican Constitution. The course will pay particular attention to the relationship between constitutional law and supranational law, the sources of the Italian and European law, the fundamental rights of the person and the regional legal system.

Program

1) The legal system: the rule of law; constitutional law; natural law and legal positivism.
2) The state elements: people, territory and sovereignty.
3) Forms of State and forms of government.
4) The international legal order and the relations with the national law.
5) The European order: history of European integration;  EU institutions; EU structural principles; relations with the Italian legal system.
6) The sources of Italian and European law.
7) The fundamental rights in the Republican Constitution and the Charter of Fundamental Rights.
8) The sovereignty of the people, the referendum and electoral systems.
9) Parliament: history, composition and functions.
10) The President of the Republic: election and attributions.
11) The government: organization and functions.
12) The regional systems: the origins, the statutory, legislative, administrative and financial autonomy of the regions.
13) The organization of local authorities: municipalities, provinces and metropolitan cities.

Learning Achievements (Dublin Descriptors)

1) Knowledge and understanding: The student should gain a thorough understanding of the basic principles of the Republican Constitution.

2) Applying knowledge and understanding: The student should achieve a thorough understanding of the constitutional organs and their mutual institutional relations.

3) Making judgements: The student should gain an understanding of the consequences of state policies on the decentralized systems of the republic.

4) Communication skills: The student should be able to speak in a debate in the classroom, supporting their arguments.

5) Learning skills: The student should be able to independently interpret the sources of law and constitutional jurisprudence

The teaching material prepared by the lecturer in addition to recommended textbooks (such as for instance slides, lecture notes, exercises, bibliography) and communications from the lecturer specific to the course can be found inside the Moodle platform › blended.uniurb.it

Teaching

Frontal lessons. Seminars with particular reference to the political and constitutional aims of the european integration.

Attendance

Frequency to at least three quarters of the lessons. Knowledge and understanding of the Lisbon Treaty, the Fiscal Compact and the ESM Treaty.

1) A. Barbera, C. Fusaro, Corso di diritto pubblico, Bologna, Il Mulino, ult. ed (ad esclusione dei capitoli: XIV, XV e XVI).

Assessment

Oral test, because it's  more adequate to verify the knowledge of the subject.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
