Learning Objectives

The prime objectives of the course are for students to acquire a complete knowledge of the structure of various complementary procedures, to acquire an in-depth knowledge of the aspects and procedures of major interest and to undertake a well-constructed investigation on the most up-to-date problems of Bankruptcy Law and of the application of reforms and successive modifications of normal procedures.

Program

The nature and characteristics of bankruptcy and of other complementary procedures. The reform of the Bankruptcy Law. The essential requirements and objectives of bankruptcy. The declaration of bankruptcy: initiative, competence, procedure, demand rejection, judgement declaration and relative judgements. Organisations that deal with bankrupcy. The effects of bankruptcy on the property of a debtor. The restoration of property guarantees. Carrying out compulsory credit claims and the regulation of credit consultations. The procedure to verify liabilities:  credit checks and laws on property. Liquidation and division of assets. Bankruptcy and debt closure. Company bankruptcy. Agreed estimates and accords on the restructuring of debts. Compulsory liquidation administration. Extraordinary administration of large companies in a state of insolvency. Signs of bankruptcy criminal activity.

Learning Achievements (Dublin Descriptors)

The student that has passed the exam has: 

- a general knowledge and a good comprehension of legal process and procedures; 

- a deep understanding of the institutes that regulate the various procedures of Italian directives and of those of the European Comunity; 

- a general knowledge of the institutes that oversee Common Law;

- a concrete capacity to elaborate on legal documents related to legal procedures.

Possibility for the students to sit the exam discussing specific arguments of the course through the editing of a brief elaborate script.

However, as an alternative, for greater subject depth:

 2) - F. Ferrara, Bankruptcy, Giuffre, Milan, Ultimate Edition (limited to the course subjects).

Students are advised to equip themselves with a complete civil code of subsidiary laws and of a code of civil procedure.  

Assessment

Oral exam.

The expected learning results will be evaluated by means of an oral exam, based on three questions or more. The evaluation criteria and the scale of marks are as follows:

less than 18/30: competence level insufficient. The student doesn’t reach the learning results described in “knowledge and understanding”.

18-20: competence level sufficient. In particular, the student attains the learning results described in “knowledge and understanding”.

21-23: competence level satisfactory. In particular, the student attains the learning results described in “knowledge and understanding” and in “applied knowledge and understanding”.

24-26: competence level good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding” and “making judgments”.

27-29: competence level very good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “communication skills”.

30-30 with honours: competence level excellent. The student fully attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “learning skills”.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
