The course aims to provide the basics in order to understand the phenomenon of territorial decentralization in Italy. The state is a regional state. Since 2001, Title V of the Constitution has strengthened regional powers. The jurisprudence of the Constitutional Court has specified the areas of competence State-Regions. The course provides useful tools to overcome these problems. 

In the propaedeutic part the course will deal with the following topics: 1. Unitary State, Federal State and Regional State. 2.- The regionalism and its historical evolution. 3.- The new Italian regionalism after the reform (L. Cost. 3/2001). 4.- Statutory autonomy and regional statutes. 5.- Legislative autonomy. 5.- Regulatory autonomy and administrative functions. 6.- Administrative federalism 7.- Organs and constitutional functions of the Regions. 8.- State, regional and local government reports. 9.- The recent jurisprudence of the Constitutional Court. 10.- The regions and the European Union. 11.- The adaptation to international law and the foreign power of the regions. 12. Financial autonomy: the so-called fiscal federalism. 13.- Controls (on the acts) and on the organs of the regions. 14.- Elements of comparative and European regional law. The course will also examine the recent modification of Title V of the Constitution, which took place in 2015-2016, to be submitted to a constitutional referendum.

The student must demonstrate knowledge of the classification criteria developed by the doctrine, in synchronic and diachronic terms.

Applying knowledge and understanding 

The student must demonstrate knowledge of the dominant characteristics of the individual legal phenomena, knowing how to interpret and frame them within the legal systems, the forms of state and government.

Making judgments

The student must demonstrate the ability to assess the originality of institutional innovations, finding the analogy or the difference with respect to the classified models.

Communication skills 

The student will have to demonstrate the appropriate use of the expressive language of the cataloged legal phenomena, in order to allow the fruitful dialogue with the teacher and the other students.

Learning skills 

The student must demonstrate that he has acquired a series of concepts, principles and classifications that can be used in the continuation of legal studies and professional activity.

Assessment

The exam assessment procedure is mainly oral. At the option of the students, it is possible to fill in any in-depth theses with oral discussion, in cases where there is the possibility of experimenting with profitable group work. This mode allows students to experiment in collective form, enhancing the specific attitudes of students. The expected learning outcomes will be evaluated by formulating three or more questions.

The evaluation criteria and scores are determined according to the following scale:

less than 18/30 - insufficient level: the candidate does not reach any of the learning outcomes foreseen in the point "knowledge and understanding";

18-20 / 30 - sufficient level: the candidate achieves, in particular, the learning outcomes foreseen in the point "knowledge and understanding";
