Learning Objectives
The epic event that has inaugurated the 21st century - the attack on the Twin Towers in New York on September 11, 2001 - gave unprecedented importance to the public good of security in all its dimensions: external and internal security; individual right to security or collective security of rights; safety in the material sense and in the ideal sense. In certain cases, the protection of public security can arrive to justify the adoption of exceptional measures that question the foundations of the rule of law, as has happened in the case of the Covid-19 pandemic. The aim of the course is to provide students with the legal categories and methodological tools for framing the public good of territorial security in the various forms of state: absolute, liberal, democratic-pluralist and social. The course will also focus on the regulatory relevance of security in the Italian constitutional system and in the European space of the internal market.
Program
- Introduction to the course and fundamental legal concepts.
- Security of rights and right to security.
- The different facets of security: external and internal security; individual and collective security; safety in the material sense and in the ideal sense.
- The public good of security in the evolution of the form of state: absolute, liberal, democratic-pluralist, totalitarian, social.
- The 'militant' democracy.
- Security and state of emergency. The case of the Covid-19 pandemic.
- Balance between values and principles underlying the public good of territorial security.
- Security in the constitutional order.
- The European area of freedom, security and justice and the immigration.
- Security in constitutional and supranational case-law.

The course will take place mainly through lectures, in which the active and critical participation of the students will be stimulated, especially with the discussion in the classroom

- Assessment
Oral exam. This assessment method allows the evaluation in the most complete way of the analytical and critical abilities required from the student as well as the student's communication skills, in consideration of the complexity of the topics of the course of which he must demonstrate knowledge
- Disability and Specific Learning Disorders (SLD)
Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.
To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
