Program

The Course will focus on:
a.    The distinction between the status of political asylum, refugee status and the international application applicants. The rights of migrants and asylum seekers in the European legal system: right to entry and stay in the territory and the legal procedures; detention and restriction of personal freedom, forced returns. Civil, political and socio-economical rights of the migrants and asylum seekers.
b.    The EU governance of the immigration phenomenon based on three pillars: - the «principle of the safe country of origin»; - the institutionalization of administrative detention; - the externalisation of the protection procedure to a third country (Hotspots and Frontex);
c.    The case law of the European Court of Human Rights and the European Court of Justice on the relevant EU regulations and directives. The judicial review and the guarantees of the rule of law in the Member States.
