Learning Objectives

The essential objective of the course is the analysis of the founding reasons of the various models of regulation of economic dynamics and the related implications. This objective passes through the understanding of the fundamental difference between the public and private dimensions of economic law and of the institutions that pertain to one and the other. The course aims to specifically address the issue of new opportunities and problems deriving from the multilevel regulation of economic dynamics, which has replaced the traditional one at a purely state level.

Program

The course will open with an introduction concerning the evolution of economic law as a scientific-disciplinary sector, focusing, in particular, on the preliminary analysis of the two dimensions that characterize it: private law and public law. The sources of economic law will be examined from a multilevel perspective: international, Euro-unitary, national. Attention will be paid to the transformations - both quantitative and qualitative - of the nature of public intervention in the economy, deriving, in particular, from the creation of the single European market and from the evolution of antitrust law. The innovations concerning the Italian Republic in its articulations - with particular attention to the Independent Regulatory Commissions -, the European Union and international organizations, as well as those relating to the regulation of market subjects (companies, consumers, users), will therefore be explored.

The analysis of the subjects and functions regulated by the sources of economic law will focus especially on the concepts of "relevant market", of "market power" and on the main forms of anti-competitive behavior: agreements, abuse of dominant position , the concentrations. The main forms of action to protect competition, both public and private, will therefore be examined: in particular, the sanctions and actions aimed at compensation for damages.

The general problems analyzed during the course will be applied to case studies selected and indicated by the lecturer.

The course aims to enable students to achieve:
- critical capacity and analysis skills in relation to the fundamental issues of economic law, in its multilevel dimension;
- ability to re-elaborate and apply the principles and rules learned during the course to specific situations;
- ability to clearly explain and use the specific language and terminology of the sector correctly;
- knowledge and understanding of antitrust and market law, both in private and public law dimensions;
- ability to interpret the provisions of economic law.
