The course aims to provide students with the knowledge of Family Law, both in its overall and general framework, and with an analytical study of the institutes and related profiles of greater importance, also in light of the constant evolution of the normative and jurisprudential, and of the critical analysis provided by the doctrine

Fundamental characteristics of family law. The families in general - Law of persons and the function of the family - Civil unions - The de facto family - The celebration of marriage - The invalidity of marriage - Personal relations between spouses - Alimony - Property relations between spouses - Family business - The separation of spouses - Divorce - Filiation, formal and substantial constitution of the relationship - Adoption and custody - Medically assisted procreation

Students must have taken the exam of Private law institutions

Law graduates who have taken the family law exam have: - complete knowledge and understanding of the basic legal sectors; - in-depth knowledge of the fundamental rules of family law and its main institutions, as they emerge in the international and national legal system; - knowledge of the procedures for judicial and extrajudicial resolution of disputes relating to family matters; - ability to understand purposes, contexts and consequences of family law policies; - ability to elaborate legal documents in the context of negotiation, out-of-court and judicial contexts relating to the matter of family relationships.

Ability to apply knowledge and understanding

Law graduates who have taken the family law exam have: - the ability to interpret and apply the rules of the legal system of national and international family law; - the ability to find, also through databases, to understand and use the sources of family law, and to analyze the relevant jurisprudence. Autonomy of judgment (making judgments) The student who takes the family law exam has: interpretative ability, case analysis and qualification of the relationship between facts of reality and legal case in point, in order to be able to identify, represent and resolve problems related to the protection of people's rights in family and emotional relationships and conflict management.

Communication skills

The student who has taken the family law exam has: ability to describe and investigate legal problems relating to family law in the relationship both with operators and professional subjects, and with potential customers or subjects in any case interested; ability to illustrate the logical-legal paths that lead to the solution of the theoretical and applicative problems posed; ability to convince and present arguments, even in contradiction with other qualified subjects.

Learning skills

Law graduates who have taken the family law exam have: acquired the skills and basic tools for the constant updating of their skills in the field of personal and family rights; ability to understand the complexity of related legal phenomena; ability to independently follow the evolution of family law (jurisprudence of merit and legitimacy) and to deepen it using all the knowledge, even instrumental, necessary and acquired during the course of study.

Assessment

Oral examination

This method of assessment allows to evaluate the acquisition of the analytical and critical skills required of the student in consideration of the complexity of the topics covered by the course (of which he must demonstrate critical knowledge and understanding), and also to appreciate the student's communication skills. The expected learning outcomes will be assessed by formulating at least three questions.

The evaluation criteria and scores are determined according to the following scale:

less than 18/30 - insufficient level: the candidate does not achieve any of the learning outcomes indicated in the point "knowledge and understanding";

18-20 / 30 - sufficient level: the candidate reaches, in particular, the learning outcomes indicated in the point "knowledge and understanding";

21-23 / 30 - fully sufficient level: the candidate reaches, in particular, the learning outcomes envisaged in the points "knowledge and understanding" and "applied knowledge and understanding";

24-26 / 30 - good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding" and "independent judgment";

27-29 / 30 - very good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Independent judgment" and "communication skills"; 30-30 cum laude - excellent level: the candidate fully achieves the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Autonomy of judgment"; "Communication skills" and "ability to learn".

Intermediate tests may be carried out. The teacher will be able to draw elements of evaluation of the learning maturity also from the flipped learning activity of the single student.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.

Teaching

For non-attending students Innovating teaching might be substituted with alternative learning methods, even online, and others such as specific essays concerning topics of Family Law.
