Learning Objectives

The course is designed to develop the knowledge and understanding of European and Italian Banking and financial law. 
The course provides an in-depth analysis of banking and financial supervisory framework.  

Program

Evolution of italian banking law.

  • Since the Unification of Italy to the Bank Law of 1926 and 1936;
  • Since the Bank Law of 1936 to the 80's;
  • The implementation of the II EU Directive and the Consolidated Law on Banking;
  • From the Consolidated Law on Banking to the financial crisis of 2007.

Banking Authorities

  • Public organizations in charge of banking sector. CICR and the Ministry of Economy and Finance;
  • The Bank of Italy prudential supervision 
  • The Bank of Italy and the Eurosystem monetary policy;
  • Anti money-laudering and anti-usury supervision;
  • The new role of ECB in banking supervision.

Banks and financial markets

  • Banking activity definition;
  • The subjects of financial sector;
  • Specialization, unspecialisation and pluralism of banking system.

Banking Activity Authorization.

Branch-banking and free provision of services.

Banks different models.

Special credits.

The bank's balance-sheet.

  • Supervisory and investigatory powers;
  • Regulatory supervision;
  • Organizational adequacy;
