Learning Objectives

The course aims to provide students with a general education, an institutional nature but supported by a metodology aims to contribute to a problematic and critical approach, the concepts and fundamental legal categories of private law, with particular attention to the areas most relevant to the objectives peculiar to the educational curriculum. The course aims to the acquisition by the student of a knowledge characterized by a good level of knoledge of the discipline in the traditional issues of private law - in particular, subjective circumstances, real situations, bonds, contracts, and although with more synthetic approach, family discipline and civic responsibility - and it is also intended to provide the student with an education - even in the rendering necessary synthesis of a merger into a single course of private law and commercial law - also with respect to the issues fundamentals of business law, with specific reference to the profile of the entrepreneur and the different company types.

Learning Achievements (Dublin Descriptors)

A) knowledge and understanding (knoledge and understanding): the student must demonstrate that they have acquired a good grasp of the concepts and fundamental legal categories of private law, as well as knowledge of the discipline of its private law - with particular reference to the specific situations , to real rights, obligations and the contract - and commercial law, with attention paid to the various figures of entrepreneur and various corporate types.
B) apply knowledge and comprehension skills (applying knoledge and understanding): the student will have to prove that you understand the practical purpose that inspires the legal science, and consequently to be able to use the theoretical knowledge acquired in a functional way to solving problems, questions, controversies current or potential which necessarily invest the professional consultant work.
C) independent judgment (Making judgments): the student must demonstrate ability to interpret the current standards in the private-sector and commercial law, as well as to understand and apply the principles established by case law.

D) communication skills (communication skills): students must demonstrate adequate expressive skills you've learned, as well as the use of a specific legal-technical language, both theoretical and reconstructive purposes of the legal framework, both at the time of their practical implementation and concrete.

E) capacity to have to learn: (learning skills): the student must demonstrate that they have developed the ability to appropriate learning and functional to the future acquisition, even independently, additional levels of learning and investigation of the matter.

Teaching Material

Seminarial activity, possibly also characterized by the use of a casistic method, based on the examination of the case law or contract forms.

Teaching

Frontal lessons.

Attendance

There is no obligation to attend. However, it is especially recommended the attendance of the course, which, moreover, is an essential condition for the student to be able to subdivide the large and challenging program of study into two sections, with assessment intemedia written upon completion of the first and additional written test in the outcome to complete performance of the program.

Course books

Recommended, especially for students attending, the adoption of the text of P. Perlingieri, Istituzioni di diritto civile, ESI, Napoli, latest edition, as well as the study of the notes relating to conducted lectures, both by the course teacher who by contract teachers entrusted with the handling of certain issues - which have integrative function than the manual.
Students - attending and yet not - can alternatively use another manual of your choice, they are asked to specify before starting the exam.
In reference to the Commercial law students can use a handbook of commercial law of their choice.
Necessary to use, in support of an updated Civil Code.

Assessment

Oral examination.
Reserved for the attending students: two written tests, one after the holding of the first part of the program - with the assignment of an indicative and provisional vote - and one in response to the performance of the second part of the program, with the final assignment of a final mark and unitary.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.

Notes

In the Department is active the 'Olympus Observatory for the permanent monitoring of legislation and case law on safety in the workplace'. It carries out various activities including, in particular: - the management of a website with legislative databases, case law and contractual requirements concerning safety in the workplace; - Depth articles, specialized reviews and "focus" theme; - The management of an online scientific journal - "The Working Papers of Olympus", shortly destined to mutate into "Diritto alla sicurezza sul lavoro" (DSL) - in the field of law of security in the workplace, with ISSN, which makes use of a large international scientific committee and refereeing procedures for the identification of essays to be published; - The organization of events congresses and seminars including international. This observatory, whose website is freely accessible to all in a logic of public service, allows students of the Study course to find useful materials and documentation to study and draft the dissertation. It offers, also, through the mentioned congresses meetings and seminars, the opportunity to meet with leading experts in the field and a full analysis of the most sensitive issues relating to it.
