Learning Objectives

To provide students with in-depth knowledge and skills in relation to the new recent legislation on the labor market.

Program

The course includes in-depth study of the reforms adopted in the course of implementation of the so-called Jobs Act. In particular, they will be dealt with the following topics, in order: 

1) the Act no. 183/2014; 2) the contract protections growing (Legislative decree no. 23/2015); 3) the forward contract and the review of other types of contracts (Legislative decree no. 81/2015); 4) the employment services and active policies (Legislative decree no. 150/2015); 5) the social safety nets (Legislative decree no. 22/2015 and Legislative decree no. 148/2015 ); 6) the inspection activity (Legislative decree no. 149/2015).

Learning Achievements (Dublin Descriptors)

A) Knowledge and understanding: students will have to demonstrate that they have acquired a thorough knowledge of the latest labour market reforms, as well as the ability to understand purposes, contexts, and consequences of the law policies implemented in recent times on labour law matters.  B) Applying knowledge and understanding: students will have to demonstrate the ability to apply the knowledge acquired in order to interpret laws and cases law. C) Making judgements: students will have to demonstrate that they have acquired the ability to deal with the legal issues with method and assessment autonomy. D) Communication skills: students will have to demonstrate that they have acquired a strong command of the legal language. E) Learning skills: students will have to demonstrate the ability to follow the changes in legislation and case-law in order to upgrade their skills.

The acquisition of the described skills will be verified through mid-term and final exams.

The teaching material prepared by the lecturer in addition to recommended textbooks (such as for instance slides, lecture notes, exercises, bibliography) and communications from the lecturer specific to the course can be found inside the Moodle platform › blended.uniurb.it

The materials needed for the exam, consisting of doctrinal essays, will be shown and made available to students at the beginning of the course.

The teaching material made available by the lecturer can be found, together with other supporting activities, inside the Moodle platform › blended.uniurb.it

It’s also required to show up to class equipped with updated labor codes.

Assessment

The final exam consists of an oral discussion. In addition to knowledge of the study materials, it also requires the ability to frame the topics covered in the broader thematic context in which there are the legislative reforms implemented.

Students assiduously attending lectures will support a mid-term test, the details of which will be agreed with the teacher.

For a better understanding of the topics covered, to students do not attend lectures we recommend the reading of parts of the manual used for the labor law exam, specifically the parts related to the issues addressed in the essays.

Notes

The course is borrowed from that played in the Master’s Degree in Law. Therefore, the lessons will be held at the same time.

In the Department is active "Olympus", the Observatory for permanent monitoring of legislation and case law on health and safety in the workplace work.

The Observatory carries out various activities including, in particular:

- the management of a website with legislative databases, case law databases and databases of contracts, all concerning the safety at work;

- depth articles, specialized reviews and thematic focus;

- the management of an online scientific journal - "The Working Papers of Olympus", soon destined to mutate into “Law of occupational Safety and Health" (DSL) - in the field of security rights in the workplace, with ISSN, that employs a wide international scientific committee and refereeing procedures for the identification of essays to be published;

- the organization of congresses and seminars including international ones.

This observatory, whose website is freely accessible to all in a logic of public service, allows students of the CdS to find useful materials and documentation for their course of study and useful to draft their dissertation. It offers, also, through the mentioned congresses and seminars, the opportunity to meet the leading experts in the field and to analyse the most sensitive issues relating to it. http://olympus.uniurb.it/
