Learning Objectives

The student must be able to define and contextualize fundamental rights in the history of the modern state, distinguishing the ethical and political aspects from the legal aspects of the problem. He/she will have the basic knowledge on internal, European and international protection of rights. Making use of the Universal Declaration, the Constitution and other legal texts, he/she will have to demonstrate the mastery of the basic vocabulary of rights.

Program

The course aims to introduce students to the concept of fundamental rights, through an interdisciplinary approach, both historical and philosophical-juridical. The following questions will be addressed.

- Moral and law

- Constitutionalism

- Historical development of fundamental rights

- International protection of human rights

- Human rights and globalization

Learning Achievements (Dublin Descriptors)

1. The student must understand the concept of fundamental rights, inserting the various topics in a historical and socio-political context ("knowledge and understanding skills");

2. He/she will have to argue its own positions in the field of rights protection policies.

3. He/she will have to distinguish the ethical-political and legal aspects of the issues dealt with.

4. He/she will have to demonstrate the ability to synthesise and correctly use the technical-legal language, albeit at an elementary level.

5. He/she will have to interpret texts related to the theme of rights in other contexts of study and work, being able to update his/her knowledge.

Lectures with reading and commentary of texts. Students will be encouraged to intervene by proposing their own arguments on the teaching topics, to be discussed in the class.

Oral exam, consisting of three or more questions. The evaluation criteria are: definition of the main concepts, reconstruction of the historical development of the protection of rights, ability to link the topics in an interdisciplinary context.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
