Learning Objectives
The course aims to deepen the principles of economic criminality and aspects of criminal law protection of the public economy, industry and commerce (Book II, Title VIII, Articles 499-518 of the Criminal Code).
Program
- Concepts of economic crime, penalties, confiscation.
- Criminal liability of individuals: own crime, guarantee positions, risk assessment, delegation of functions, de facto administrator, liability of collective bodies.
- Liability of entities for facts of crime: interest or advantage of the entity, organizational fault, compliance programs.
- The types of offences that protect the public economy, industry and commerce (Book II, Title VIII, Articles 499-518 of the Penal Code).

- Assessment
The examination includes an oral test to verify the necessary preparation through the reasoned explanation of the institutions and the links between them, also assessing the achievement of an adequate expressive and organizational capacity of speech (three or more questions in 'double step': member of the commission and professor of criminal law).
The evaluation criteria and scores are determined according to the following scale:
- less than 18/30: insufficient level of competence. The candidate does not achieve any of the expected learning outcomes under 'knowledge and understanding';
- 18-20/30: sufficient level of competence. The candidate achieves, in particular, the learning outcomes expected under 'knowledge and understanding';
- 21-23/30: fully sufficient level of competence. The candidate achieves, in particular, the learning outcomes foreseen under 'knowledge and understanding' and 'applied knowledge and understanding';
- 24-26/30: level of competence: good. The candidate achieves, in particular, the learning outcomes foreseen under 'knowledge and understanding', 'applied knowledge and understanding' and 'autonomy of judgement';
- 27-29/30: very good level of competence. The candidate achieves, in particular, the learning outcomes foreseen under 'knowledge and understanding', 'applied knowledge and understanding', 'autonomy of judgement' and 'communication skills';
- 30-30 cum laude: excellent level of competence. The candidate fully achieves the expected learning outcomes under 'knowledge and understanding', 'applied knowledge and understanding', 'independent judgement', 'communication skills' and 'learning ability'.
- Disability and Specific Learning Disorders (SLD)
Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.
To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
