Learning Objectives
The essential objective of the course is the analysis of the founding reasons of the various models of regulation of economic dynamics and the related implications. This objective passes through the understanding of the fundamental difference between the public and private dimensions of economics law and of the institutions that pertain to one and the other. The course aims to specifically address the issue of new opportunities and problems deriving from the multilevel regulation of economic dynamics, which has replaced the traditional one at a purely state level.
Program
The Course will open with an introduction having as its subject the debate on economic relations in the Constituent Assembly, as well as a preliminary analysis of the two dimensions that characterize economics law: the private and the public ones.
The sources of economics law will be examined from the multilevel perspective: international, euro-unitarian, and national. Attention will be paid to the transformations - both quantitative and qualitative - of the nature of public intervention in the economy, arising, in particular, from the creation of the European single market and the evolution of competition law. Thus, innovations concerning the Italian Republic in its articulations - with particular attention to Independent Regulatory Commissions - will be sounded out, as well as those concerning the discipline of market subjects: companies, consumers, users.
The analysis of the subjects and functions regulated by the sources of economics law will focus especially on the concepts of "relevant market", "market power," and the main forms of anticompetitive behavior: restrictive agreements, abuse of dominant position, and merger operations. The forms of action to protect competition, both public and private, will then be examined: in particular, sanctioning measures and actions aimed at compensation for damages.
The general issues analyzed during the course will be applied to case studies selected and indicated by the lecturer.

The course aims to enable students to achieve:

critical capacity and analysis skills in relation to the fundamental issues of economic law, in its multilevel dimension;

ability to clearly explain and use the specific language and terminology of the sector correctly;

ability to interpret the provisions of economic law.

- Assessment
Each student, whether attending or not, is entitled to take the final examination exclusively by means of an oral discussion dealing with the topics covered in the reference texts indicated above. The mode of the oral interview makes it possible to assess in the most complete way, in addition to the student's communicative ability, the acquisition of the analytical and critical skills required of the student in view of the complexity of the themes and arguments covered by the course whose knowledge and understanding he or she must demonstrate.
In the aforementioned discussion, the expected learning outcomes will be assessed through the formulation of three or more questions. Evaluation criteria and scores are determined according to the following scale:
- less than 18/30 - insufficient level: the candidate does not achieve any of the expected learning outcomes under "knowledge and understanding";
- 18-20/30 - sufficient level: the candidate achieves, in particular, the learning outcomes stipulated under "knowledge and understanding skills";
- 21-23/30 - fully sufficient level: the candidate achieves, in particular, the learning outcomes stipulated under "knowledge and understanding skills" and "applied knowledge and understanding skills";
- 24-26/30 - good level: the candidate achieves, in particular, the learning outcomes stipulated in the points "knowledge and understanding skills"; "knowledge and understanding skills applied"; and "autonomy of judgment."
- 27-29/30 - very good level: the candidate achieves, in particular, the learning outcomes stipulated in the points "knowledge and understanding ability"; "applied knowledge and understanding ability"; "autonomy of judgment" and "communication skills";
- 30-30 cum laude - excellent level: the candidate fully achieves the learning outcomes stipulated at the points "knowledge and understanding ability"; "knowledge and understanding ability applied"; "autonomy of judgment"; "communication skills" and "ability to learn
- Disability and Specific Learning Disorders (SLD)
Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.
To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
