This course is entirely taught in Italian. Study materials can be provided in the foreign language and the final exam can be taken in the foreign language.

Learning Objectives

The course - divided in two parts (the general part and the monographic one) - provides a systematic study of the right of workers' safety, through the analysis of the prevention principles and rules contained in the legal system (national, international and Community) and in collective bargaining.

The course’s method, which combines traditional teaching (lectures) with innovative-experimental techniques (Debate, Flipped Learning and use of the Moodle-blended learning platform), is aimed at developing both basic and higher cognitive knowledge.  In this way, through the direct debate with the teacher and the work in the classroom (Teaching Working Class), we want to encourage the learning process through a more student’s effective involvement and a better organization of the teaching materials, to facilitate the knowledge processes during the course’s development.

Program

Lessons program covers the following topics, in order:

General Part  -  On the protection of the health and safety of workers before the legislative decree no. 81/2008

1) Into national law:

a) the legislation: The constitutional principles -  Code-related regulations (art. 2087 c.c.) and the  "special legislation" of the 50's - The legislative decree 1994, no. 626. (outline and structure)
b) the Collective bargaining: -The evolution of the collective bargaining both at company and at national level, and the contribution to strengthening protections on health and safety of workers - The article 9 of the so-called "Workers' Statute" - Workers' safety representative provided by the legisaltive decree 1994, no. 626 (outline and functions)

2) In the international and European order: Health and safety of workers as a fundamental social right - The main ILO Conventions on health and safety of workers - European Framework Directive of 1989 and the sectoral directives - The case law of the Court of Justice (case law relevant on the subject)

 
Monographic part   - Title I of the Legislative Decree no. 81/2008 (as amended by the legislative decree no. 106/2009)

1) The evolution and the characteristics of the "new discipline"

2) The objective field of application and the subjective one

- The definition of the employer for health and safety at work within both the private sector and the public administration

- The notion of workers, of those equivalent to them, and their computation

3) The institutional system

 - The Steering and Evalutation Committee for Active Policies,  the Standing Advisory Committee, the National Coordination Committees, the national public bodies, the SINP (The national information system for prevention in the workplace), the Commission of article 12

- The inspection activities and the suspension of business

 4) Workplace health prevention

- the general measures to be adopted to protect health, the office delegation and  the obligations of the actors involved in the company prevention system (employer, supervisors, managers, competent doctor)
- The supply conctract, the DUVRI (the interference risk assessment report), the enterprise qualification system

- The Risk Assessment and the organizational models

- The Prevention and Protection Service (SPP) and its Manager (RSPP)

- The information and the training

- The health surveillance and the competent doctor

- The Workers' Safety Representative and the role of joint bodies

5. The protection of workers' health and safety at the time of Covid 19

6. Technological innovations and Artificial Intelligence between risks and potential.

A) Knowledge and understanding:

Students will have to demonstrate that they have acquired, also in a view of dynamic evolution, a thorough understanding of purposes, contexts, problems and possible consequences of the policies of international, European and national law on health and safety of workers.

B) Ability to apply knowledge and understanding:

Students will have to demonstrate the ability to apply their knowledge in interpreting the sources of law and contract law in force in the Italian legal system and also the case law on health and safety of workers.

C) Making judgments:

Students will have to demonstrate that they have acquired the ability to address the technical and legal issues with method and assessment autonomy.

D) Communication skills:

Students will have to demonstrate to have acquired a strong command of the legal language.

E) Learning skills:

Students will have to demonstrate that they are able to update their knowledge in the light of any change in the legislation and in the collective bargaining, as well as in the light of the interpretation of case law.

Teaching Material

The teaching material prepared by the lecturer in addition to recommended textbooks (such as for instance slides, lecture notes, exercises, bibliography) and communications from the lecturer specific to the course can be found inside the Moodle platform › blended.uniurb.it

Supporting Activities

The acquisition of the described skills will be verified through exercises and mid-term self evaluation.


Teaching, Attendance, Course Books and Assessment

Teaching

The course will take place in the Second semester. 

The face-to-face teaching will take place in traditional (lectures) and in innovative-experimental mode (Teaching Working Class). The teaching activities will be enriched with insights that students will carry out using the University Moodle platform. Furthermore, the course will be accompanied by an articulated tutoring activity. 

The lessons in the Teaching Working Class and tutoring activity aim to provide students an opportunity for in-depth study and thinking on the most relevant issues.

In agreement with the students, collective meetings can be organized in mixed mode, aimed to providing clarifications and carrying out a possible key topics review of the program addressed in class.

Assessment

Oral discussion, based on three questions or more.

Students assiduously attending lectures will support, through an oral exam or a written multiple choice test, a mid-term test concerning the general part of the course.

The evaluation criteria and the scale of marks are as follows:

less than 18/30: competence level insufficient. The student doesn’t reach the learning results described in “knowledge and understanding”.

18-20: competence level sufficient. In particular, the student attains the learning results described in “knowledge and understanding”.

21-23: competence level satisfactory. In particular, the student attains the learning results described in “knowledge and understanding” and in “applied knowledge and understanding”.

24-26: competence level good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding” and “making judgments”.

27-29: competence level very good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “communication skills”.

30-30 with honours: competence level excellent. The student fully attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “learning skills”.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.

Without prejudice to the same size of the study programs, in order to give non-attending students the opportunity to compensate with independent study what is covered during the lessons, dedicated materials will be indicated on the Blended platform which, referring to the same contents of the program, will facilitate their full understanding (slides, short essays, diagrams and summary sheets).

Notes

In the Department is active "Olympus", the Observatory for permanent monitoring of legislation and case law on health and safety in the workplace work. The Observatory carries out various activities including, in particular: - the management of a website with legislative databases, case law databases and databases of contracts, all concerning the safety at work, - depth articles, specialized reviews and thematic focus; - the management of an online scientific journal - "The Working Papers of Olympus", soon destined to mutate into "Law of occupational Safety and Health" (DSL) - in the field of security rights in the workplace, with ISSN, that employs a wide international scientific committee and refereeing procedures for the identification of essays to be published; - The organization of congresses and seminars including international ones. This observatory, whose website is freely accessible to all in a logic of public service, allows students of the CdS to find useful materials and documentation for their course of study and useful to draft their dissertation. It offers, also, through the mentioned congresses and seminars, the opportunity to meet the leading experts in the field and to analyse the most sensitive issues relating to it. http://olympus.uniurb.it/
